1. Acceptance of Terms

By accessing or using Brits Academy's services, website, or mobile application, you agree to be legally bound by these Terms and Conditions . These Terms govern your use of our educational platform, including all content, functionality, and services offered. If you do not agree with any part of these Terms, you must immediately discontinue use of our Services.

2. Eligibility Requirements

To register and maintain an account with Brits Academy, you must meet the following criteria:

• Age: Be at least 13 years of age. Users under 18 require parental or guardian consent to use our Services.
• Accuracy: Provide complete, current, and accurate information during registration and maintain its accuracy.
• Compliance: Adhere to all academic policies, community guidelines, and behavioral standards established by Brits Academy.
• Authorization: If registering on behalf of an organization, have authority to bind that organization to these Terms.

3. Account Security & Responsibilities

As a registered user, you are solely responsible for:

• Confidentiality: Maintaining the secrecy of your login credentials and not sharing accounts.
• Activity: All activities conducted under your account, whether authorized by you or not.
• Security: Promptly notifying us of any unauthorized access or security breaches at academybrits@gmail.com.
• Access: Ensuring your device meets our minimum system requirements for optimal service functionality.

4. Content Policy & Intellectual Property

When using our Services, you agree:

• Ownership: Brits Academy retains all rights to platform content, including courses, materials, and branding.
• User Content: You maintain ownership of content you create but grant us a license to display and distribute it through our Services.
• Restrictions: Not to upload/share content that:
  • Infringes on copyrights, trademarks, or patents
  • Contains viruses, malware, or harmful code
  • Is defamatory, obscene, or promotes illegal activities
  • Violates privacy rights or contains sensitive personal information

5. Payments, Refunds & Subscription Terms

• Fees: All course fees and subscriptions are clearly displayed before purchase. Prices may change with 30 days notice.
• Payment: We accept major credit cards and mobile payment options. Recurring payments will auto-renew unless canceled.
• Refunds: Requests must be submitted within 14 days of purchase for unused courses. Refunds processed within 7-10 business days.
• Chargebacks: Unauthorized payment disputes may result in immediate account suspension and collection efforts.

6. Termination & Account Suspension

Brits Academy reserves the right to suspend or terminate accounts for:

• Violations of these Terms or academic integrity policies
• Fraudulent activity, including payment fraud or false credentials
• Inactivity exceeding 12 consecutive months
• Behavior that disrupts the learning environment or harasses others

Upon termination, you lose access to all course materials and services. Certain provisions survive termination.

7. Limitation of Liability

To the maximum extent permitted by law, Brits Academy shall not be liable for:

• Service interruptions beyond our reasonable control
• Accuracy of third-party content or external links
• Indirect, incidental, or consequential damages
• Loss of data, profits, or business opportunities
• User-generated content or conduct of other users

8. Dispute Resolution

Before initiating formal proceedings, you agree to:

• Notify us in writing of any disputes at academybrits@gmail.com
• Participate in good-faith negotiations for at least 30 days
• If unresolved, disputes shall be settled through binding arbitration in Kenya under Governing Laws and arbitrator participation
• Class actions and jury trials are expressly waived

9. Modifications to Terms

We may update these Terms periodically to reflect:

• Changes in our services or business practices
• Legal or regulatory requirements
• Security or technical considerations

Material changes will be communicated via email or platform notice 30 days in advance. Continued use constitutes acceptance.
